| A validity search attempts to uncover
issued patents or other published prior art that may render a
patent partially or completely invalid. In contrast, validity
searches can also be used to invalidate an in-force patent thereby
allowing a company to practice that technology without paying
royalties to the firm that holds the rights to the patent in question.
TT Consultants has special teams of patent crunching engineers
working full time on patent validity searches; these engineers
are skilled in the art of patent invalidation. Searches are
conducted on paid as well as non paid databases. A concise report
containing the details of the search conducted, databases searched,
key strings used, search strategies adapted and relevant parts
of the citations is presented to the client.
We adapt the following search strategies for conducting patent
validity searches (patent and non patent literature search):-
Keyword based search: The keyword based search
is conducted as under:-
• Key Features of the invention are identified based
on the novel aspect of the invention.
• Relevant key words and their variations are determined
based on the key features and the technology domain.
• Different key strings with variable scope (broad to
narrow) are formed and a search is conducted on different databases.
• Search results obtained from the search strings are
analyzed and relevant patent publications are identified.
• Relevant Classes are identified and search is conducted
in the relevant classes.
Citation Analysis: A citation based analysis
is conducted for all the relevant publications found during
the search.
Assignee/Author based search: An assignee
based analysis would be conducted for all the relevant publications
found during the search.
Inventor based search: An inventor based analysis
would be done for all the relevant publications found during
the search.
The Search reports may thereafter be examined and legally correlated
by the concerned attorney in the context of the litigation.
